Loss of Mental Capacity

If someone loses their mental capacity or physical ability to look after their own affairs, only their legally appointed Attorney or their Deputy under a Deputyship Order has the authority to handle their financial affairs and make decisions about their health, medical treatment and welfare.

No one likes to think about a day when perhaps they will need help to make the right decisions about their financial or personal affairs or that they will need to rely on someone to make the right decisions for them about such matters. Power of Attorney/Court of Protection/Deputyship

Deputyship - Court of Protection

If someone is no longer capable of managing their own financial affairs and they do not have a valid Enduring Power of Attorney or Lasting Power of Attorney (Property and Affairs), it may be necessary for the Court of Protection to appoint a Deputy to manage their affairs. The Deputy will take responsibility for the incapacitated person's finances under the guidance of the Court of Protection and the Office of the Public Guardian.
