If a church meets the criteria set in medieval times it can register its interest in your property to meet the costs of repairing the church chancel. This interest will remain on the title and will not be removed unless agreed by the church. Churches have a right to register chancel repair liability until October 2013.
St Eadbugha’s Church in Broadway recently decided to register their chancel repair interest against some local Broadway homes, however, after debate an exemption was granted and the claim withdrawn. Although a positive resolution for the Broadway property owners, risk of chancel repair liability remains for many others.
QualitySolicitors Parkinson Wright undertakes a Chancel Check search as a compulsory search in the purchase conveyancing process. If a chancel repair liability is detected, Indemnity Insurance can be taken out to cover against the potential risk. This offers peace of mind and protection to property owners, their lenders and can include successors in title to ensure the issue is covered for onward sale.
This one off indemnity insurance premium will vary depending on the insurance company and the level of cover.
