Small claims court

If you owe money to a person or company and have been unable to pay, they may take legal action and use the small claims procedure to recover the money from you.

The small claims court refers to small claims (debts of up to £10,000) that go through the court system. You could be taken to court using the small claims procedure by an individual or a company that you owe money to, or by a landlord, for instance if you owe them money for rent or repairs.

Often, the first time you will be aware that they are taking action is when you receive a claim form stamped by the court. This could be delivered in the post or be given to you in person. It’s important not to ignore the form; if you do, decisions could be made in court without you having the opportunity to put your case forward.

If you have received a claim form, you may wish to seek legal advice about the best way to proceed. At QualitySolicitors Parkinson Wright our experienced lawyers can explain the small claims process, help you complete the relevant paperwork and plan the best course of action. If you are struggling to pay debts, we can help you put a debt management plan in place so that you can regain control of your finances.

Expert legal advice you can rely on:

Debt

When you’re struggling to deal with debt, it’s easy to feel out of control. The first step to getting back on track is to ask for help.

Bankruptcy

If you owe money that you cannot pay, you may decide to declare yourself bankrupt. In some situations, if you owe £750 or more, the people you owe money to may apply to make you bankrupt. Becoming bankrupt is often seen as a last resort but, for some, bankruptcy can be a relief – putting an end to months or years of financial uncertainty.

Debtors and debt management

When debts begin to mount up, you can find that several companies are asking you for money at once.

Small claims court
