Sexual Abuse Claims

Deliberate sexual abuse will constitute trespass to the person. The definition of trespass to a person is:

  • Assault—where the perpetrator acts in such a way to cause the claimant to believe that they are about to be attacked.
  • Battery—the perpetrator intentionally and directly uses physical force.
  • False imprisonment—where the victim is deprived of their freedom of movement without lawful justification.
