If you’ve answered yes to these questions, you may be able to make a claim for Hand Arm Vibration Syndrome (HAVS), also known as Vibration White Finger (VWF) under a no win, no fee agreement.
You do not still need to be employed by Balfour Beatty Utility Solutions Ltd to make a claim and you do not need to have seen your GP to have the condition diagnosed.
In June 2018, Balfour Beatty Utility Solutions Ltd were fined £500,000 and ordered to pay costs of £195,000 for regularly exposing their workers to the risk of developing HAVS from using hand held vibrating tools.
HAVS is a permanent condition that affects the blood vessels and nerves in the hands. Typical symptoms include numbness, pins & needles, tingling and whitening of the fingers; symptoms are often worse in cold weather.
The symptoms can lead to difficulties in carrying everyday activities such as picking up small objects, fastening buttons; they can also affect the strength of your grip and general manual dexterity.
The Health & Safety Executive found that Balfour Beatty Utility Solutions Ltd failed to assess the risk to their workers’ health; failed to put in to place suitable risk control measures or to monitor them; failed to implement a suitable system of health surveillance and failed to report the significant number of their employees who had been diagnosed with HAVS.
