I was sacked. It was an unfair dismissal. What can I do?
If you believe you have been unfairly dismissed then you will need to take legal advice quickly because of the short deadline that may apply – please use our Free First Step service today so that we can let you know whether you are likely to have a good claim.
To be able to bring a claim you must have worked continuously for 12 months for the employer. Where you worked a notice period (rather than being paid) before dismissal that can be counted towards the 12 months.
You will have a good claim if your employer sacked you without good reason or they did not follow a fair procedure.
However, you will not have a claim if your employer can show that the reason for your dismissal was due to your behaviour or because you lacked the capability needed for the job (such as skills, qualifications or health) or the reason you left was that it was your retirement or they had to make you redundant (perhaps because the business was doing badly).
Even if your employer can rely on one of these reasons (and there are others) you may still have a good claim if the surrounding circumstances were unfair. We will discuss with you the fairness of the process followed and also other factors such as the size and resources of the employer.
If it looks like you can bring a claim for unfair dismissal we will discuss the outcome that you would want to achieve whether it is going back to your original job or a similar job or compensation.
