Will our child/children be protected by a premarriage agreement?

Yes, they can if you make provision for them. If either of you have children from a previous relationship the agreement can record whether there are any assets you both wish to keep for that child (or children). You can also make provision for any children you have together as a couple.

It is important to know that if the relationship were to break down, the court is not obliged to follow your agreement - it must put the child's interests first. However it is likely to be influenced by what is said in the premarriage agreement where it is seen as having been fairly entered into.
