How are the financial arrangements sorted out on divorce or dissolution?
For married couples or those in a Civil Partnership there is a formal process - starting with mediation. This sees if you can reach agreement. After this there are other steps that are more formal and they are:
- You complete a detailed financial circumstances form
- You review the one completed by your partner – your lawyer does this with you and together you decide what questions you want to ask. You may think your partner hasn’t provided full and proper details so you can ask about this for example
- The court reviews the paperwork after which there is a ‘Financial Dispute Resolution’ hearing – think of this more as a negotiation than a trial
- If an agreement is not reached a final hearing is arranged where both sides present their evidence before a judge – and the judge decides what final orders are made.
Decisions a judge can make include a ‘clean break’ arrangement – one where a single lump sum is paid to end the financial relationship between you and your partner – or a lump sum payment and ongoing regular payments or ‘maintenance’.
