What is annulment of a marriage?

Annulment is a declaration by the court that a marriage was or has become invalid. Annulment can be an option other than divorce - and you do not need to wait twelve months to start the process. Finances and issues with children are sorted out in the same way as a divorce but unlike divorce or dissolution all annulment cases go to court.

An annulment may be granted for any of the following reasons:

  • If either of you were already married to someone else at the time of your marriage
  • If either of you could not give valid consent to the marriage - perhaps one person lacked the mental capacity
  • If either of you were under sixteen at the time of the wedding
  • If you weren’t a male/female couple
  • If you were closely related to each other for example father and daughter or brother and sister
  • If your partner had a communicable form of a sexually transmitted disease when you got married
  • If the wife was pregnant with someone else’s child and the husband didn’t know about it
  • If you didn’t conform with the proper legal requirements such as not filling in forms properly
  • If the marriage was never consummated (due to lack of capacity or refusal)
